General terms and conditions of business
Our general terms and conditions are pre-formulated contractual conditions. They are valid for purchases in the Wäscheflott online shop.
1. scope and definitions
For the business relationship between the company Wäscheflott, Ing. Rudolf Stekl KG, Vienna, (hereinafter referred to as „Wäscheflott“ or „seller“) and the customer (hereinafter referred to as „customer“), the following General Terms and Conditions of Business shall apply exclusively in the version valid at the time of the respective order. Any conflicting or other general terms and conditions and/or other terms and conditions of the customer, irrespective of their designation, are expressly contradicted unless the seller expressly agrees to their validity in writing. Individual agreements made with the customer in individual cases (including collateral agreements, supplements and/or amendments) shall in any case take precedence over the General Terms and Conditions of Business of the seller. The content of such agreements shall be governed by a written contract and/or the written confirmation of the Seller. This also applies to the waiver of this written form requirement.
2. conclusion of contract / possibility of correction
The internet pages of Wäscheflott merely represent an invitation to the customer to submit offers to conclude a sales contract for the presented goods. The order confirmation sent to the customer by e-mail does not yet lead to a sales contract. This only takes place with the delivery of the goods, this represents the declaration of acceptance. No contract is concluded for goods that are not delivered. Wäscheflott reserves the right to refuse the conclusion of a contract, the decision on this is at the discretion of the seller. Minor colour deviations of the goods displayed on the website are due to technical reasons. Wäscheflott does not accept orders from customers who are under 18 years of age. An order is only possible if all mandatory fields marked with * in the order form are filled in. If information is missing or if Wäscheflott is not able to fulfil the order for other reasons, the customer will receive an error message. Before the order is finally sent, the customer is given the opportunity to correct his order. The customer receives supporting information directly during the order process. As soon as the order process is completed, the customer is notified by an information window „Your order is completed and has been successfully shipped“. This does not constitute acceptance of the customer‘s offer.
3. order confirmation
The customer's order data is stored. If the customer wishes a printout of his order, he has the possibility to print an „order confirmation“. This will appear on the customer's screen after the customer has sent the order to Wäscheflott by pressing the “Send Order“ button and his payment details have been successfully checked. In addition, the customer will be notified of the receipt of his or her order via the e-mail address provided by the customer when the order has been received by Wäscheflott. This notification does not constitute an acceptance of his offer.
4. prices and shipping costs
The prices are stated in EURO including the legally valid sales tax. Wäscheflott will inform the customer of the respective shipping costs in the order form. The customer shall bear the shipping costs. In the case of delivery to a non-EU country, the customer must additionally bear all import and export expenses as well as any customs duties, fees and charges. Any foreign bank charges are also to be borne by the customer. Customs duties, fees and charges as well as handling fees of the carrier will not be refunded to the customer in case of a return shipment.
5. delivery, delivery periods, availability of goods, dispatch
Wäscheflott manufactures the ordered product(s) for the customer according to the customer's specifications (size, fabric etc.). For this reason, delivery times of approx. four weeks can be expected. Wäscheflott delivers to the delivery address provided by the customer.
If at the time of the customer's order the product selected by the customer cannot be manufactured or not manufactured within the specified delivery period due to unavailability of the required raw material or other production-related reasons and therefore cannot be delivered or not delivered within the specified delivery period, or if Wäscheflott cannot meet the specified delivery periods due to force majeure or other reasons beyond its control, the customer will be informed by Wäscheflott immediately. At the same time, Wäscheflott will set a new delivery deadline for the customer that is appropriate for the respective circumstances. If the goods are still not available within the new delivery period for reasons beyond Wäscheflott's control, Wäscheflott may withdraw from the contract in whole or in part. Wäscheflott will immediately reimburse the customer for any payments already made. If the customer cannot reasonably be expected to accept the delivery due to the delay, he/she may withdraw from the contract by immediate declaration in text form (i.e. in writing, by fax or e-mail) to Wäscheflott.
If the customer has ordered several articles, it may happen that Wäscheflott will send them in several deliveries. Wäscheflott will inform the customer about this before shipping. If a part of the goods ordered by the customer is temporarily or permanently unavailable, this part of the order will be cancelled. In the shipping confirmation only those parts of the order are mentioned which are actually available. Thus, a contract is only concluded for the available goods listed in the shipping confirmation. However, a contract is not concluded for parts of the order that are not available.
Depending on which shipping method is more cost-effective, the goods will be shipped by GLS or by post, or by EMS if the customer so desires. The risk of damage shall pass to the customer upon delivery of the goods to the carrier, otherwise upon the occurrence of default of acceptance by the customer. If the customer receives goods obviously damaged by the transport, he can make use of his right of return.
6. right of withdrawal
Customers can withdraw from the contract within 14 days of receipt of the ordered goods without giving reasons in writing (e.g. letter, e-mail) or by returning the goods. It is sufficient if the declaration of withdrawal is sent within the period. In the event of withdrawal, a full or partial refund of the purchase price will only be made concurrently with the return of the goods received from the customer. The customer must return the goods in unused and as new resaleable condition and in the original packaging. In the case of articles that are impaired by signs of use, Wäscheflott will charge an appropriate fee for the reduction in value. The same applies if accessories or parts are missing when the goods are returned. There is no right of return if the original label has been removed from the goods, as in this case Wäscheflott must assume that the customer has accepted the goods. For the customer, the period begins with the dispatch of the goods or the request for return, for Wäscheflott with the receipt. The costs of the return shipment shall be borne by the customer. Should the goods be returned freight collect, Wäscheflott is entitled to withhold a corresponding amount or to invoice it.
If there is a defect in the goods, the customer is entitled to demand supplementary performance (new delivery or removal of defects). However, Wäscheflott is entitled to refer the customer to a new delivery if the removal of the defect would involve disproportionate effort. Commercial or technically unavoidable, material-related deviations in quality, colour, size, equipment or design of the goods are irrelevant. There is no right of withdrawal in the case of such or other insignificant defects. The customer is at liberty to prove that the deviations mentioned are significant for him. Warranty rights of the customer do not exist if he has modified the goods and the defect was caused by this. The customer uses the original packaging for the return shipment. If the goods consist of several individual parts, the customer shall restore the delivery condition.
8. retention of title
Until the purchase price has been paid in full, the delivered goods remain the property of the seller. The customer is obliged to inform the seller immediately in writing in the event of a seizure of the goods or other interventions by a third party, as well as to inform the third party of the seller's reserved property.
Customers can pay for their order at Wäscheflott by credit card or bank transfer via their online bank account. Wäscheflott only accepts the payment methods indicated to the customer during the ordering process. All payments as well as credit notes will be processed exclusively in EURO. 10. data processing, data protection
The customer agrees that the following personal data, namely name, first name, address, a possibly differing delivery address, as well as an e-mail address for future order processing in the Wäscheflott online shop or for the personalization of online shop offers or the newsletter are stored and processed. The customer agrees to receive news about products of the company, current offers and other company related information by means of advertising e-mail, especially newsletters. The customer can revoke his consent to receive such e-mails at any time by entering his e-mail address in the „Newsletter“ menu on www.waescheflott.com and by clicking the „Unsubscribe“ button. The personal data of the customer, which become known to Wäscheflott in the course of a business relationship, will of course be treated confidentially.
11. choice of law, effectiveness
Austrian law applies to all contracts and agreements between the customer and Wäscheflott, excluding the UN Convention on Contracts for the International Sale of Goods. Place of performance is Vienna/Austria. Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. Instead of the invalid provision, the relevant legal provisions shall apply.
